NOTICE TO BIDDERS
Sealed bids will be received at the Office of the Village Clerk, Village of Brewster, Village Hall, 50 Main Street, Brewster, New York 10509, until 11:00 A.M. on October 29, 2021 immediately after which the bids will be opened publicly and read.
The work under this Contract comprises the furnishing of all tools, equipment, materials and labor for the construction of the Village of Brewster Wells Park Bike Connector located in Brewster, New York, complete, in place, tested and ready for use in accordance with the Contract Documents prepared by J. Robert Folchetti & Associates, L.L.C.
The principal features of the Work to be performed for this Project include:
- The proposed use of the property is to create a Passive Recreation Area
and non-motorized trail connecting Wells Park to the Putnam County Trailway system. Improvements under this project will include the installation of an approximately 800 LF asphalt trail with retaining walls and guide rail for biking and walking.
The foregoing is a general description only and shall not be construed as a complete description of the Work to be performed for this Project.
One Bid will be received. Bids shall be on a unit price basis.
Prevailing wages established under the Davis-Bacon act will apply to this Contract. The Contract Documents contain requirements addressing prevailing labor wage rates, labor standards, nondiscrimination in hiring practices, goals for minority and female participation, MBE and WBE participation, Section 3 requirements, and related matters.
Contract Documents may be examined at the Brewster Village Hall or the office of the ENGINEER, J. Robert Folchetti & Associates, L.L.C., 31 Sodom Road, Brewster, NY. Copies may be obtained from the offices of J. Robert Folchetti & Associates, LLC, 31 Sodom Road, Brewster, NY 10509, beginning on October 14, 2021, Monday through Friday between 8:30 am and 4:30 pm.
Prospective bidders requests for mailing of Contract Documents will be filled by Federal Express or UPS. Prospective bidders shall furnish a prepaid Air Bill. Neither the OWNER nor the ENGINEER will be responsible for full or partial sets of Contract Documents, including any Addenda, obtained from other sources.
Bid security, and proof of qualifications to perform the Work shall be as described in the Instructions to Bidders.
Bidders shall comply with all special and statutory requirements in accordance with the Instructions to Bidders.
Contract time of commencement and completion will be as specified in the Agreement.
Each bid shall be accompanied by, a Bid Bond, the coverage of which is specified in the Instructions to Bidders. The Bid Bond Form is contained herein as part of the Contract Documents. Bonding Firm must be listed in OMB Circular 570.
Prevailing Wage Rates under Davis Bacon and MBE/WBE, as applicable, apply to this Contract.
This project is subject to the provisions of Article 5-A of the General Municipal Law of the State of New York and certificates required thereunder shall be available for public inspection at the office of the Village Clerk, Village of Brewster, NY.
For any reason whatsoever or for no reason the Village reserves the right to waive any informalities in the bids or to reject any and all bids. No bidder may withdraw his bid except by written request submitted at least twenty-four hours before the time for opening or until the lapse of 90 days after the actual opening thereof.
The Village is exempt from payment of sales and compensating use taxes of the State of New York and of Cities and Counties on all materials to be incorporated into the Work. These taxes shall not be included in the Bid.
The Village will furnish the required certificates of tax exemption to the CONTRACTOR for use in the purchase of supplies and materials to be incorporated into the Work.
The Village's exemption does not apply to construction tools, machinery, equipment or other property purchased by or leased by the CONTRACTOR, or to supplies or materials not incorporated into the Work.
Non-Discrimination and Affirmative Action Policy:
It is the policy of the Village that their Contractors shall comply with all Federal, State, and local law, policy orders, rules and regulations which prohibit unlawful discrimination against any employee or applicant for employment because of race creed, color, or national origin, sex, sexual orientation, age, disability or marital status and will take affirmative action to insure that they are afforded equal employment opportunities.
Provisions concerning this requirement are detailed in the Supplementary Conditions.

2021 Refuse Bid
Sealed bids or proposals will be received by the Board of Trustees of the Village of Brewster, Putnam County, New York, at the office of the Village Clerk, 50 Main Street, Brewster, New York until 10:00 A.M. on October 8, 2021. Bids will be publicly opened and read at 10:05 A.M. for the RESIDENTIAL REFUSE, BULK AND RECYCLABLE MATERIAL COLLECTION CONTRACT for the Village of Brewster. Specifications can be obtained from the Village Clerk at her office on any business day between the hours of 9 A.M. and 1:30 P.M. or on the Village website, here. The municipality is exempt from any Federal, State or Local taxes. The Board of Trustees reserves the right to reject any or all bids and to make award where in its opinion the best interest of the Village of Brewster will be served.

Moratorium on Water Service Termination, Moratorium on Water Relevy, and Opportunity for Deferred Payment Agreements
NOTICE TO RESIDENTIAL AND SMALL BUSINESS WATER CUSTOMERS
THE STATE OF EMERGENCY EXPIRES ON DECEMBER 22, 2021
On May 11, 2021 Governor Cuomo signed into law amendments to the Public Service Law that prevent municipalities and public utilities from terminating water service provided to residents and small businesses for non-payment during the COVID-19 state of emergency. Additionally, the amendments prevent municipalities from relevying previously accrued water charges on or after May 11, 2021 until either the end of the COVID-19 state of emergency, which is December 22, 2021.
All water suppliers must notify residential and small business customers of the protections afforded under the law.
Please be advised that service termination and relevying past due water charges is prohibited until December 22, 2021, for those residential and small business customers who have experienced a change in financial circumstances due to the COVID-19 state of emergency.
If you are a resident or small business that has experienced a change in financial circumstances due to the COVID-19 state of emergency and would like to request relief from service termination and relevying during the 180 days after the COVID-19 state of emergency expires, you must contact Village Clerk Michelle Chiudina at 845-279-3760 or via email,
Please be further advised that the law does not eliminate a customer’s obligation to pay accrued charges. However, customers who have experienced a change in financial circumstances due to the COVID-19 state of emergency must be provided with the opportunity to enter into a deferred payment agreement without the imposition of deposits, late fees, or penalties.
If you are a residential or small business customer who has experienced such a change in financial circumstances and wish to enter into a deferred payment agreement to address any outstanding or accrued payments, you must contact Village Clerk Michelle Chiudina at 845-279-3760 or via email,
Customers that do not request protection from service termination, or relevying, or do not enter into a deferred payment agreement, will be subject to the enforcement and lien provisions authorized by State and local law upon the expiration of the Public Service Law’s protections.

Village Offices Closing Early for Memorial Day
The Village of Brewster Offices will be closing early on May 28, 2021 at 1:00 PM and will not reopen until Tuesday, June 1, 2021 at 8:00 AM. The Village of Brewster Court window will not open until 9:00 AM.
There will be a Memorial Day Parade hosted by the VFW Post 672 starting at 11:00 AM along North Main Street, Main Street and Railroad Avenue. There will be a ceremony at Veteran's Park following the parade.

PUBLIC HEARING UNDER THE EMINENT DOMAIN PROCEDURE LAW IN REGARD TO THE URBAN RENEWAL PLAN FOR THE BREWSTER URBAN RENEWAL AREA
NOTICE IS HEREBY GIVEN, that the Board of Trustees of the Village of Brewster, pursuant to Article 2 of the Eminent Domain Procedure Law of the State of New York, shall hold a Virtual Public Hearing on the 17th day of February, 2021 at 7:30 p.m. or as soon thereafter that evening as possible on Zoom Cloud Meeting, Meeting ID: 207 812 8623, and is available by phone 1-929-205-6099 on the Urban Renewal Plan for the Village of Brewster Urban Renewal Area, as duly adopted by the Village of Brewster Board of Trustees on or about May 18, 2016.
The purpose of the hearing will be to discuss and consider the acquisition by eminent domain of fee simple property interests in certain real property parcels, lots and/or tracts of land located within the Village of Brewster in accordance with, and in furtherance of the public purposes of the referenced Urban Renewal Plan. Such discussion and consideration of the acquisition by eminent domain of said property interests shall include and not be limited to those real property parcels, lots and/or tracts of land which have been specifically identified in the referenced Urban Renewal Plan, as well as certain other parcels, lots and/or tracts of land not identified in the referenced Urban Renewal Plan for which the acquisition of such fee simple therein would also be in accordance with, and in furtherance of the public purposes of the referenced Urban Renewal Plan.
