Open Position with Village of Brewster DPW

OPEN POSITION – DPW LABORER

A Public Works Laborer is responsible for the operation of a variety of construction and maintenance equipment and for performing manual labor activities as needed and/or required by the Public Works Department.  Included is road maintenance, park maintenance, signage, sewer repairs and other related areas.

The position requires operation of Village owned vehicles, such as pick-up trucks, backhoe, dump trucks, salt spreaders, snow plows, etc. as required.  The operation of power tools and equipment, such as mowers, chain saws, air compressors, etc. when required, is also necessary.  The laborer will be required to inspect and repair equipment as required by department procedures as well as be able to make repairs to Village roads, street, curbs, and sidewalks as required.

The applicant will mow grass, plant and/or prune trees, flowers and hedges.  There is a requirement to maintain the municipal buildings, designated parking lots, clean the DPW garage and park facilities, as well as clean up litter and empty trash cans.  Maintenance of sanitary and storm sewers and/or conducting routine maintenance procedures is required.  Sweeping and cleanup of debris and materials from roads will be required as well as snow and ice removal, including manual shoveling of snow.  Conducting other job related duties as needed.

A valid New York State driver’s license is required.  The laborer will be required to perform heavy manual labor, including lifting heavy objects up to fifty pounds and working in all types of weather conditions.  Safety procedures and practices are required to be followed, as well as wearing safety equipment.  A good working relationship with co-workers and the general public is a necessity.  The laborer must be able to be called out for emergencies such as snowfall, floods, downed trees, sewer back-ups and must be knowledgeable in a variety of semiskilled and skilled maintenance tasks.

PROPOSED LOCAL LAW # 2 OF THE YEAR 2022

PLEASE TAKE NOTICE, that the Board of Trustees of the Village of Brewster will hold a Public Hearing on Local Law No. 2 of 2022 – Which will amend the following Village Codes: Chapter 263-3(B), Chapter 263-10, and Chapter 263-20. Copies of the proposed local law will be available BELOW and at Village Hall. The Public Hearing will take place during the Village Board Meeting of July 20, 2022 at 7:30 P.M at Village Hall, 50 Main Street, Brewster, NY 10509. Anyone wishing to speak may do so.

BE IT ENACTED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF BREWSTER,
COUNTY OF PUTNAM, STATE OF NEW YORK AS FOLLOWS:

SECTION 1 : AUTHORITY

THIS CHAPTER IS ADOPTED PURSUANT TO THE AUTHORITY, OF ARTICLE 2, §10 OF THE NEW YORK STATE MUNICIPAL HOME RULE LAW.

SECTION 2 : AMENDMENT OF § 263-3(B)

CHAPTER 263 OF THE CURRENT CODE OF THE VILLAGE OF BREWSTER, SPECIFICALLY §263- 3(B) “DEFINITIONS” IS HEREBY AMENDED TO ADD THE FOLLOWING DEFINITION:

LIGHT MANUFACTURING: 
LIGHT INDUSTRIAL PROCESS WHERE ALL PROCESSING, FABRICATING, ASSEMBLY, OR DISASSEMBLY OF ITEMS TAKES PLACE WHOLLY WITHIN AN ENCLOSED BUILDING.

SECTION 3 : AMENDMENT OF § 263-10

CHAPTER 263 OF THE CURRENT CODE OF THE VILLAGE OF BREWSTER, SPECIFICALLY §263-10 ENTITLED “B2 DISTRICT (BUSINESS 2)” SPECIFICALLY §263-10 IS HEREBY AMENDED TO READ AS FOLLOWS:

H. SPECIAL EXCEPTION USES. WITHIN ANY B2 DISTRICT, THE FOLLOWING SPECIAL EXCEPTION USES SHALL BE ALLOWED, SUBJECT TO THE REQUIREMENTS OF § 263-20:
(1) MIXED USE CONSISTING OF RETAIL ON THE FIRST FLOOR AND RESIDENTIAL ABOVE THE FIRST FLOOR;
(2) LIGHT MANUFACTURE, ASSEMBLY AND FINISH OF RESIDENTIAL AND HOME CONSTRUCTION COMPONENTS AND FIXTURES.

SECTION 4 : AMENDMENT OF §263-20

CHAPTER 263 OF THE CURRENT CODE OF THE VILLAGE OF BREWSTER, SPECIFICALLY §263-20 ENTITLED “SPECIAL EXCEPTION USE PERMITS”IS HEREBY AMENDED TO ADD NEW §263-20(I)(11) TO READ AS FOLLOWS:

11. LIGHT MANUFACTURING IN B2 DISTRICT. IN ADDITION TO THE BULK REQUIREMENTS SET FORTH IN §263-10 OF THIS CHAPTER, THE FOLLOWING REQUIREMENTS SHALL ALSO APPLY TO ALL ANY LIGHT MANUFACTURING USE AS PERMITTED IN §263-10(H)2) OF THIS CHAPTER:
(A) OWNER AND/OR OCCUPANT SHALL INSTALL A DUST COLLECTION SYSTEM AS CONDITION OF ANY SPECIAL EXCEPTION USE PERMITTED UNDER §263-10(H)2) OF THIS CHAPTER;
(B) OWNER AND/OR OCCUPANT SHALL OBTAIN AND REMAIN CURRENT ON ALL APPROVALS FROM AGENCIES/AUTHORITIES HAVING JURISDICTION OVER SAID USE AS CONDITION OF ANY SPECIAL EXCEPTION USE PERMITTED UNDER §263- 10(H)2) OF THIS CHAPTER.

SECTION 5 – HOME RULE

NOTHING IN THIS LOCAL LAW IS INTENDED, OR SHALL BE CONSTRUED TO LIMIT THE HOME RULE AUTHORITY OF THE TOWN UNDER STATE LAW OR TO LIMIT THE TOWN’S DISCRETION IN SETTING FEES AND CHARGES IN CONNECTION WITH ANY APPLICATIONS REQUIRING TOWN APPROVAL.

SECTION 6 – SEVERABILITY

IF ANY PART OR PROVISION OF THIS LOCAL LAW OR THE APPLICATION THEREOF TO ANY PERSON OR CIRCUMSTANCE BE ADJUDGED INVALID BY ANY COURT OF COMPETENT JURISDICTION, SUCH
JUDGMENT SHALL BE CONFINED IN ITS OPERATION TO THE PART OR PROVISION OR APPLICATION DIRECTLY INVOLVED IN THE CONTROVERSY IN WHICH JUDGMENT SHALL HAVE BEEN RENDERED AND SHALL NOT AFFECT OR IMPAIR THE VALIDITY OF THE REMAINDER OF THIS LOCAL LAW OR THE APPLICATION THEREOF TO OTHER PERSONS OR CIRCUMSTANCES, AND THE TOWN BOARD OF THE VILLAGE OF BREWSTER HEREBY DECLARES THAT IT WOULD HAVE PASSED THIS LOCAL LAW OR THE REMAINDER THEREOF HAD SUCH INVALID APPLICATION OR INVALID PROVISION BEEN APPARENT.

SECTION 7– EFFECTIVE DATE

THIS LOCAL LAW SHALL TAKE EFFECT IMMEDIATELY UPON FILING IN THE OFFICE OF THE SECRETARY OFSTATE IN ACCORDANCE WITH SECTION 27 OF THE MUNICIPAL HOME RULE LAW.

Proposed Local Law #1 of the Year 2022 - Videoconferencing

Pursuant to Public Officers Law § 103-a public bodies are authorized to conduct meetings using videoconference technology so long as a quorum of the public body is physically present at one or more of the locations where the public can also attend in person. This requirement can be satisfied, for example, if three members of a five‐member public body are physically present in the municipal hall and the public is allowed to attend at that location, or if three members of a five‐member public body are participating via videoconference from three different locations and the public is allowed to be physically present at each of those locations.

A member of a public body may participate in a meeting of a public body without allowing members of the public to be physically present at the location from which they are participating in the meeting if extraordinary circumstances exist such as disability, illness, caregiving responsibilities, or any other significant or unexpected factor or event which precludes the member's physical attendance at such meeting.

If a public body broadcasts its meetings or conducts its meetings via videoconference, it must use technology that permits members of the public with disabilities to access the video in a manner consistent with the 1990 Americans with Disabilities Act (ADA). Information on how meetings can be made accessible to attendees with disabilities can be found online at www.section508.gov/create/accessible-meetings/. In addition, local officials should consult with their municipal attorney to ensure compliance with this requirement.

Local Law No. 1 of the year 2022

Village of Brewster, County of Putnam

A local law adopted pursuant to Public Officers Law § 103-a authorizing the use of videoconferencing within the Village of Brewster.

Section 1. Legislative Intent

It is the intent of this local law to authorize the Village of Brewster to conduct meetings consistent with the videoconferencing provisions of Public Officers Law § 103-a and the videoconferencing polices adopted by the Board of Trustees.

Section 2. Authority

This local law is adopted pursuant to Public Officers Law § 103-a, which expressly authorizes the Board of Trustees to adopt local legislation, authorizing the use of videoconferencing.

Section 3. Videoconferencing for Public Meetings

The Board of Trustees of the Village of Brewster, County of Putnam, hereby authorizes the use of videoconferencing when conducting meetings of the Board of Trustees subject to the following:

1. A quorum of the members of any Village Board (Board of Trustees, Planning Board, Zoning Board of Appeals) are physically present at the meeting in one or more physical locations at which members of the public may attend the meeting.

2. Members of the Village Board are physically present at the meeting location(s) at which the public can attend in person unless the member of the Board is unable to be physically present due to extraordinary circumstances:

a. Extraordinary circumstances is defined to include any disability or illness, caregiving responsibilities, or any significant or unexpected factor or event that precludes the Village Board member's physical attendance at such meeting.

b. Extraordinary circumstances must be certified by email or other written means to the Village Clerk by the member of any Village Board in accordance with the Village’s videoconferencing policies and procedures and not less than 72 hours prior to any meeting.

3. Except in the case of executive sessions conducted pursuant to Public Officers Law § 105, members of the Village Boards must be able to be heard, seen, and identified while the meeting is being conducted, including but not limited to any motions, proposals, resolutions, and any other matter formally discussed or voted upon.

4. The minutes of meetings involving videoconferencing must include which, if any, members of the Village Board participated using videoconferencing technologies.

a. Such minutes must be made available to the public pursuant to Public Officers Law § 106.

b. Any meeting that uses videoconferencing must be recorded and such recordings must be posted to or linked on the Village website within five business days of the meeting. The recordings must remain available for a minimum of five years thereafter and recordings must be transcribed upon request.

5. The public notice for any meeting involving videoconferencing must:

a. Inform the public that:

i. videoconferencing will be used,
ii. where members of the public can view and/or participate in such meeting via videoconference, and
iii. where required documents and records will be posted or available; and

b. Identify the physical location(s) where members of the Village Board will be physically present at the meeting and where members of the public can attend the meeting in person.

6. Members of the public are able to view the video broadcast of any meeting using videoconferencing simultaneously when the meeting is conducted. Additionally, at meetings where public comment or participation is authorized by the Village Board, members of the public are able to participate in the proceedings using videoconference technologies in real time and with the same opportunities for public participation or testimony as in-person participation or testimony.

7. Village Board body may conduct meetings entirely by videoconference, with no in-person requirement, provided that:

a. A state of emergency is declared by the Governor of the State of New York pursuant to Executive Law § 28, or

b. A local state of emergency is declared by the Chief Executive Officer of the Village pursuant to Executive Law § 24, and the Board of Trustees determines that the circumstances necessitating the emergency declaration would affect or impair the ability of the public body to hold an in-person meeting.

8. Whenever the Board of Trustees invokes the emergency exception as defined in paragraph 7 and takes action at such meeting without allowing members of the public to be physically present, the Board of Trustees must acknowledge the previous meeting(s) and summarize any action(s) taken thereat at the next immediate meeting where the public is allowed to attend. The Board of Trustees must produce minutes of such emergency meetings pursuant to the requirements of Public Officers Law § 106.

Section 4. Severability

If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

Section 5. Effective date

This local law shall take effect immediately upon filing with the Secretary of State.

Village of Brewster Memorial Day Weekend Announcements: Office Closures & Road Closures

Attention Village of Brewster Residents and Members of the Surrounding Communities:

On Monday, May 30, 2022, VFW Post 672 will be hosting a Memorial Day Parade starting at 10:30 AM at the Brewster Fire Department, going down North Main Street and Railroad Avenue and ending at 11:30 AM at Electrozone Memorial Field, with a ceremony to follow shortly after. This will require the road to be closed starting 10:30 AM and ending at 11:30 AM. Once the ceremony ends, spectators are encouraged to gather at Markel Park on North Main Street to participate in a 5K Run, which will have runners run down North Main Street, onto Main Street, then running up Peaceable Hill Road. From there, runners will make a left onto Tonetta Lake Road and another left onto Griffen Road, to merge onto North Main Street and end at Markel Park. During this time the road will be closing at 12 PM and will not reopen until 2:30 PM. Please plan your travels through this area accordingly.

The Village of Brewster Offices will be closing on Friday, May 27, 2022 at 1 PM and will not reopen until 8:00 AM on Tuesday, May 31, 2022. Starting on May 31st the Village Offices will be on Summer Hours, which is 8:00 AM to 4:00 PM Monday through Thursday and 8:00 AM to 1:30 PM on Fridays. This will be in effect until Labor Day Weekend.

850 Route 22 Application Work Session

PLEASE TAKE NOTICE, that the Board of Trustees of the Village of Brewster will hold a Work Sessions on Wednesday, May 11, 2022, beginning at 7:30 P.M. at Village Hall - 50 Main Street, Brewster, NY.  The work session is to evaluate the application for 850 Route 22 and no public comment will be taken during this time.

Hydrant Flushing April 20, 2022

What is it that makes the water turn orange when they flush the hydrant?
Minerals – Primarily Iron & Manganese
The Village of Brewster supply source is ground water drawn from five sand and gravel wells.
The semiannual hydrant flushing purges the system of the accumulated settlement of these minerals suspended in the ground water.
Opening the hydrants and increasing the water flow causes the disturbance of this settlement so that it may be flushed from the system.
Does running the tap water make it clear up faster?
No. To the contrary, running the water prolongs the turbulence in the system. The best thing to do is use as little water as possible for 12 to 24 hours so the system has a chance to settle out and clear.
Why does my toilet run after hydrant flushing?
Sometimes tiny particulate gets caught under the flush valve seal in the toilet holding tank preventing it from sealing tightly. The same can be true for washers and aerators (strainers) in faucets. Make sure your faucets and toilets are not leaking and are unobstructed after hydrant flushing. If you have strainers on washer supply hoses you should also check them but refraining from doing laundry for a 24 to 48-hour period from April 20th is recommended.
After this flushing, the next hydrant flushing is scheduled to be October 5, 2022.

Ellen Avenue Railroad Crossing Closure

The Metro North Railroad will be closing the railroad crossing by the Brewster Train Station for a grade crossing upgrade to the Ellen Avenue Roadroad Crossing.

The railroad crossing will be closed on the following dates: 

10 PM Friday, April 22 to 4 PM Sunday, April 24

10 PM Friday, April 29 to 4 PM Sunday, May 1

During these times above, all customers and residents should park their vehicles in the train station lot along North Main Street.

Non-emergency vehicles will not be able to cross the tracks while repair work is underway.

Carmel Avenue Bridge Project Schedule

Attention Residents and Commuters:

The Department of Transportation has provided the Village of Brewster a schedule with work that will be done between now and May 6, 2022. The schedule is as follows:

  1. 04/14-04/15 – Sidewalk along Carmel Ave and N. Main St
  2. 04/18-04/19 – Reconstruction of Michael Neuner Dr, with road closure and detour
  3. 04/18-04/22 – Permanent Signs and Right-of-Way fence installation
  4. 04/25-04/29 – Traffic Loops and pedestrian signal installation
  5. 04/25-04/29 – Landscaping
  6. 05/02-05/04 – Final Paving and striping.

 

UPDATE AS OF 5/3/22: Final paving will take place starting May 9, 2022. Please avoid the intersection and travel with caution while passing through the area.
