VILLAGE OF BREWSTER BOARD OF TRUSTEES

The Board of Trustees of the Village of Brewster held a Regular Meeting on 1 November 2006 at Village Hall, 208 Main Street, Brewster, New York.  The meeting was called to order at 7:30 P.M. by Mayor John Degnan.  Present were Mayor John Degnan, Deputy Mayor and Trustee  James Schoenig, Trustees William Banks, Yoshihiko Ito, and Terri Stockburger, Village Engineer John Folchetti, Village Counsel Gary Kropkowski, and Treasurer and Acting Clerk Mike Santos.

PLEASE take notice that the Board of Trustees of the Village of Brewster will continue the Public Hearing on Wednesday. 1 November 2006, at 7:30 PM, or as soon thereafter as time permits, at Village Hall, 208 East Main Street, Brewster, NY, on proposed municipal water rates.

The Public Hearing rapidly degenerated into a discussion of billing problems under the current billing rates, questionable meter readings, toilet bowl tank mechanisms, etc.  A list of complainants and contact information was taken, and a copy is attached.

PLEASE take further notice that the Board of Trustees of the Village of Brewster will hold an Executive Session of the Board of Trustees for the purpose of discussing a real estate contract on Wednesday 1 November 2006, at 7:30 PM, or as soon thereafter as time permits, at Village Hall, 208 East Main Street, Brewster, NY.

1. Public Comment

-A discussion arose regarding a Public Hearing to extend the Building Moratorium.  On motion by Mayor Degnan, seconded by Trustee Banks, and approved 5-0 by voice vote, the Village Clerk was instructed to schedule a Public Hearing on 15 November.

-Wayne Cairns discussed possible traffic problems due to re-construction of the Metro-North RR Station Plaza

-Helena Frost reminded the Board that a Jersey Barrier is still needed to protect a stone wall located on Putnam Terrace across from the Funeral Home.

2. Special Use Permit – Jan Stark – Donut Shop – tabled to 8 November Special Meeting

3. Proposal for “LUKE” Parking Kiosks and monitoring devices – Al Eggenberger of CTRNY made a Power Point presentation.  He will e-mail an electronic copy of the presentation and refined proposal numbers, as well as the State Contract numbers.

4. AFLAC – Sherri Eccleston & Phil Pearson made a sales pitch for the coming Open Enrollment period for their health insurance lines.

5. Current Water Bills
            -Moved by Mayor Degnan and seconded by Trustee Stockburger, a resolution to extend the payment deadline on water bills to 30 November was approved 5-0.

6. Request for Waiver of Moratorium
            - Linda & Steve Alongo, 571 North Main, ppd from18 Oct, was referred to the Village Engineer for further study of existing septic and use by future tenants of space involved.
            - John Jordan, 867 Route 22, did not answer when called.
            - Carlos E. Aliaga – 206 East Main Street – convert Apt to Prof. Office – during the proceedings it was discovered that the applicant had no permit for the black-topping of a driveway previously consisting of gravel.  The matter was referred to Building Inspector for further action.  The applicant then withdrew his application for a change of use.
            - Silvia Paeita – 20 Oak Street – replace existing garage – a waiver of moratorium was granted and the case referred to the Building Inspector for a Building Permit.

7. Sanitation Commissioner on new trash receptacles – After Trustee Stockburger made her presentation, upon motion by Mayor Degnan seconded by Trustee Stockburger, it was resolved to order one Sample Garbage Container from Summit Supply of Colorado from Quote # K1102066 for model # TR32 Crown with Liner, Ash Urn and surface mounting for $656 for further review by Board members.

8. Resolution to authorize the Village Clerk to reside anywhere within the County of Putnam

On a motion by Mayor Degnan, and a second by Trustee Banks, the following Resolution was introduced:

WHEREAS, the Village government has determined that it is both necessary and desirable to broaden the pool of potential employees who may be considered for the post of Village Clerk,

NOW, THEREFORE the duly constituted Board of Trustees of the Village of Brewster does hereby RESOLVE that the Clerk of the Village may be a resident of the County of Putnam, State of New York, or any political sub-divisions therein.

9. On a motion by Mayor Degnan, and a second by Trustee banks, the following Resolution was introduced:

WHEREAS, the Village government has determined that it is both necessary and desirable, as part of its mandate to remediate the effects of Stormwater Runoff under MS-4, to co-sponsor, with the NYC DEP and the Institute for Environmental Stewardship, a clean-up along the banks of the East Branch of the Croton River on 4 November 2006,

NOW, THEREFORE the duly constituted Board of Trustees of the Village of Brewster does hereby RESOLVE that the Treasurer of the Village to disburse up to $600, for refreshments for the volunteer workers, from account G8140.4, Stormwater Contractual Expense.

10. Waste Water Treatment Plant – direction of BoT on request for Certificate of Insurance.  The treasurer was directed to get a quote from the insurer for the cost of liability insurance on the bulk storage of chemicals at the WWTP.

11. New Business

- Fernando Contrais, 6 Eastview Avenue asked for a Waiver of Moratorium.  The matter was tabled until 15 November pending submission of plans.  Building Inspector instructed to inspect the premises before that date.

- Upon motion by Trustee Ito, and seconded by Trustee Stockburger, a resolution was approved 5-0 to allow parking relief in the area of the Baptist Church beginning 10 AM the next day and running for four hours thereafter.

12. Public Comment

-Denis Castelli informed the Board of an Introductory Class on GIS mapping being held by the County government, as per information from County Clerk Sant.

-Christine Piccini noted water puddles on Eastview Avenue.

13. Executive Session for the purpose of discussing confidential Personnel matters and possible litigation.

14. Mayor John Degnan announced the appointment of Peter Brewster Hansen of Patterson, New York as his choice for the position of Village Clerk.  The appointment will take effect at 0830 hours on 13 November 2006.
