1. Metro North Maintenance Agreement
The Clerk noted the scheduled transfer is scheduled for December 14th.
2. 50 Main Street
Mayor Degnan motioned and Trustee Banks seconded to declare a negative SEQRA finding. Motion passed 5 Ayes.
Mr. Lovallo asked for an explanation. Mayor Degnan said that the Village had declared its intention to be lead agency in July, 2006. Interested parties are given 30 days to respond. DEC and DEP both approved our intention As a result of the environmental form and application of renovation of an existing building, a negative declaration was made by the Village of Brewster.
3. Water Rates
The Board of Trustees has chosen to review and adopt three separate resolutions each detailing a period of time when specific water rates were or would be in effect. The Board has undertaken due diligence in determining said water rates and has solicited the public for input numerous times. The Board’s steady goal has been and continues to be to offer a fair and reasonable approach to new water rates given our substantial investment of capital to improve the water delivery service to each home in the Village. There remain some homes outside the Village limits who still receive municipal water but have not installed a metering device. For these homes, as well as those who may have nonfunctioning meters for a given time that the non-metered rate is included. We encourage all Village of Brewster municipal water users to obtain and install a water meter for their own benefit and the benefit of their neighbors. With 100% functional metering we can better detect leakage and accurately predict flows to the new Wastewater Treatment Plant.
RESOLUTION – Water Rates from October 1, 2005 to March 31, 2006

The duly constituted and authorized Board of the Village of Brewster, New York, this 6th day of December, 2006 upon motion of Mayor Degnan; seconded by Mr. Banks; does hereby resolve and state:
WHEREAS, the Village Board is authorized to establish and impose water rents pursuant to New York General Municipal Law Article 14-F of the Village Law of the State of New York, and
WHEREAS, the Village Board has previously established by Village Law Section 11-1116 a municipal system for setting water rents, inclusive of the statutory authority for the establishment or imposition of a penalty fee for late payment of rents, and
WHEREAS, the Village Board has performed its municipal due diligence in establishing uniformity and standardization in the establishment of these rates, inclusive of late penalty rules and regulations, now therefore be it
RESOLVED, that the Board of Trustees hereby authorizes the establishment of water rent rates based on prior rates set by this board. The rates set hereto in the attached schedule are equal to or lower than rates previously set by this board for this period.
FURTHER RESOLVED, that the effective date of billing based upon this new municipal usage-based rate shall be for the period October 2005 through March 2006, and be it
FURTHER RESOLVED, that all prior and previous water rent rates established by this Board of Trustees shall be deemed null and void for the effective dates and are hereby revised as established in the schedule hereto attached..

Rate Schedule
For the period April 2006 through November 2006:
[In this 8 month billing period, the gallons used to determine price levels are calculated at one-third more than the six month price levels used in the April Village Board resolution: 25,000 - 125,000 and 150,000.]
The Peaceable Hill Water District is billed at the flat rate of $0.015 per gallon.
Note: The period from April 1st through April 18th is subject to the rate in effect from the prior billing period.

WHEREAS, the Village Board has previously established by Village Law Section 11-1116 a municipal system for setting water rents, inclusive of the statutory authority for the establishment or imposition of a penalty fee for late payment of rents, and
WHEREAS, the Village Board has performed its municipal due diligence in establishing uniformity and standardization in the establishment of these rates, inclusive of late penalty rules and regulations, now therefore be it

4. Other Business
A. Holiday Parking – 2 hr. free parking
On a motion by Mayor Degnan and seconded by Trustee Stockburger the duly constituted Board of Trustees of the Village of Brewster hereby authorizes free two-hour parking for the time period of December 14, 2006 to January 2, 2007. The meters are to be covered with red holiday greetings bags stating “two hour parking free.”

Mayor Degnan made a motion to authorize the Clerk to buy additional bags to cover the meters as necessary. Seconded by Trustee Stockburger. Motion passed 5-0
B. Account signatory
The clerk requested the Board designate a third signatory to the bank accounts.
On a motion by Mayor Degnan and seconded by Trustee Ito, Deputy Mayor William Banks is to be made a signatory to the Mahopac National Bank accounts. Motion passed. 5-0
C. Trash Receptacles
Mayor Degnan made a motion and Trustee Ito seconded to authorize Teri Stockburger to buy trash receptacles that meet the aesthetic and functional needs of the Village. Motion passed. 5-0
D. Meeting date change.
Mayor Degnan made a motion to rescind the previously scheduled Dec 20, 2006 Board Meeting and to hold the last meeting of December on December 13th instead. Trustee Ito seconded. Motion passed. 5-0
E. Bulk pickup days –
The Clerk presented proposed bulk pickup days which will be the last Wednesday in April and the last Wednesday in September for the Village of Brewster. Mayor Degnan made a motion to adopt these bulk pick-up days. Trustee Ito seconded. Motion passed. 5-0
F. Public Comment.
Jack Gress asked about sewer rates now that the O&M contract is let. Mayor Degnan said Sewer rates had been adopted previously but no bills have been sent out yet.
G. Adjourn
Mayor Degnan moved to adjourn. Trustee Schoenig seconded. Motion passed 5-0
