The Board of Trustees of the Village of Brewster held a Public Hearing as described below on September 5, 2007 at Village Hall, 208 Main Street, Brewster, New York.  The Public Hearing will commence at or about 7:30 P.M. and is called to order by Mayor Degnan.

PUBLIC HEARING

PLEASE TAKE NOTICE, that the Board of Trustees of the Village of Brewster will hold a Public Hearing ON SEPTEMBER 5, 2007, at 7:30 PM. Or as soon thereafter as the business of the Board of Trustees permits, for the purpose of considering a SPECIAL USE PERMIT for a proposed Subway type franchise operation; said real property being located at 851 Route 22., in the Village of Brewster, bearing the tax parcel code, 67.36-2-3.  Plans are on file in the office of the Village Clerk and available for inspection.

The Public Hearing will take place prior to the regularly scheduled Village Board Meeting of September 5, 2007, at Village Hall, 208 Main Street, Brewster, NY, at 7:30  P.M.  Anyone wishing to be heard may do so as time permits.  The Village of Brewster will make every effort to assure that the hearing is accessible to persons with disabilities.  Anyone requiring special assistance and /or reasonable accommodations should contact the Village Clerk.

The Board of Trustees of the Village of Brewster held a Regular meeting on September 5, 2007 at Village Hall, 208 Main Street, Brewster, New York.

This Public Hearing is for a Special Use Permit – Subway sandwich shop type commercial space at 851 Rte. 22
Mayor Degnan opened the meeting, seconded by Mr. Schoenig, all in favor- passed.
Mayor Degnan began the meeting by thanking Christine Piccini, Chair of the Planning Board, for all her hard work to bring us to this point. 
Mr. Ito asked if notices were sent to all adjacent property owners informing them of the Public Hearing for the Special Use Permit.  Ms. Piccini offered that there is not a written requirement for same as far as she can find.  Mr. Stockburger, Planning Board Member, concurred that there is nothing he can find either.
Mr. Ito asked if the site plan approval had all the proper prior notifications and Mr. Aqeel said they did notify everyone and he has a record of same.
The Site Plan is approved.
The Board of Trustees accepted Mr. Aqeel’s statement of notification.

September 5, 2007

The Board of Trustees of the Village of Brewster is holding a Regular Meeting on September 5, 2007 at Village Hall, 208 Main Street, Brewster, New York.  The meeting will be called to order at or about 7:45 P.M. or immediately following the Special Use Permit Public Hearing by Mayor Degnan.

Regular Meeting

  1. Public Comment – James Thompson requested that water and sewer be brought to his vacant lot at 12  Meadow Lane.  Mr. Folchetti, Village Engineer, stated that a Y existed in the street but connection would require street work.  Since Mr. Thompson has no site plans for development there would be no reason to extend the water line now.  That would be done during development of a site plan and construction.  The sewer will be terminated at the lowest point possible to encourage gravity flow.  The lot owner will also have to connect to that sewer connection when a site plan is approved and during the construction process as is normal procedure.
    1. Mayor Degnan made a motion to instruct Cassidy Excavating to coordinate with Mr. Thompson as to a termination point for the sewer connection and authorize the work since now was the best time to provide this connection while the crew was there and the streets were dug up.  Ms. Stockburger seconds, passed 5-0
  2. 18 Prospect Street- Water bill adjustment reduce by: $149.97 for erroneous bill correction made by Hansen. 
    1. Mayor Degnan motions, to authorize a credit to this account for water service due to Mr. Hansen’s error.   Mr. Banks seconds.  Passed 5-0
  3. Establish Sewer Rents

Mayor Degnan motioned to set rates at $0.0115 per gallon based on water meter readings.  This rate plan will become effective on September 24 and billed for future use based on prior readings.  Bills will be sent out at the discretion of the Clerk with Board approval on or about every three months with the first bill being sent during October, 2007 based on Water meter readings from on or about July 1 through on or about September 30, 2007.  Those accounts inside the Village limits who do not have water meters will be charged $1,600.00 per year per unit as follows
Effective September 24, 2007 and forward Rates

    1. Charge $0.0115 per gallon based on metered water usage.
    2. Fixed Rate : No Water meter reading: $1,600.00 per unit per year prorated during the billing period.

Broken meter, bad reading, short reading: prorated based on average metered usage determined solely by the Village.  When no metered history is available, the flat rate of $1,600 per unit will be used.
Mr. Schoenig seconded.  Approved 5-0.

  1. New York State Police & Fire Retirement System – tabled.  Will be discussed again during budgetary process for 2009 fiscal year.
  2. Clerk's report – not available at meeting time.  Clerk to email copy to Board members.                      
  3. 287 (g) application
    1. Mayor Degnan proposes to apply for the Homeland Security 287 (g) program and would like consensus from the Board of Trustees that this is the right way to move forward.  Mr. Ito would like to see the Attorney weigh in on the program and is not prepared to move forward without this information.  Mr. Ito believes this is a major step for the Village of Brewster and is unsure of the benefits.  Mr. Ito believes that many municipalities have reviewed the program but few have adopted it and this concerns him.  Mr. Ito stated our Police department has no detention center and no funding for this program and would have to rely on the County for support as we do now.

Mayor Degnan espoused several positive points regarding identification and tracking of the apparently undocumented population.  Efforts would be limited in scope to tie-in to the Homeland Security ID system and would be funded by grants from State and Federal sources.  Mayor Degnan believes this program would be the best way for Brewster to proceed because it would provide a uniform constitutional process to proceed on our streets.  The program is particularly targeted toward criminal activity; tracking and prosecuting offenders while sharing information with other law enforcement agencies.
Mr. Gress asked about the costs and how many officers need to be trained.  Mayor Degnan said as many as we want and can afford pending funding sources.
Mayor Degnan motions to authorize the application to the 287 (g) program.  Ms. Stockburger seconds.  Mayor Degnan stated that the process of application will give us the time and information to answer Mr. Ito’s concerns.  Mr. Ito reiterated that he wants Mr. Kropkowski to take us through the process before applying.  Mayor Degnan asked if there was any more discussion.  Mr. Schoenig asked if we could pull out of the process at any time without incurring hard costs?  Mayor Degnan affirmed.

  1. Ground Lease for Parking Garage – hold for Executive Session
  2. AWRA Conference – Paper Accepted – Mayor Degnan requests authorization to expend appropriated monies to attend conference and give the paper.  Mr. Ito motions to approve expenditure.  Mr. Banks seconds.  Motion carried 4 Ayes, 1 Abstain (Mayor Degnan)
  3. Approval of Vouchers
    1. Total Voucher Abstract: $1,385,960.36 consisting of:
      1. A: $60,619.86
      2. F: $22,555.80
      3. G: $ 181,267.79
      4. H10: $1,039,399.45
      5. H9: $82,117.46

Mayor Degnan motions to approve vouchers, Ms. Stockburger seconds, all in favor 5-0

  1. ZBA Membership – Mr. Ruchala requests the board of trustees to consider adding Mr. James King to the Zoning Board of Appeals.  Mayor Degnan said he received Mr. King’s resume and knows Mr. King personally.  The Mayor believes he would be a good addition to the ZBA. 

Mayor Degnan motions to appoint Mr. King to the Zoning Board of Appeals with approval from the Board of Trustees and swearing in by the Clerk, Mr. Banks seconds.  Passed 5-0.

  1. Brewster on the Move – September 30th video – Mr. Ruchala asked for authorization to expend up to $2,000 on a video promoting Brewster as was done previously.  He would like to do this during Founders Day.  Ms. Stockburger motions to approve up to 50% of the cost of the video not to exceed $2,000.00, Mr. Banks Seconds, Vote 3-0 with Mr. Schoenig and Mayor Degnan abstaining.
  2. New Business
    1. Mr. Ito question why the parking ticket revenue has declined year over year.  Has a shift in focus been made?  Mr. Mancone says that no conscious shift has been made but the officers are investing more time on criminal activity, safety and security of residents than before.  They are often calling or being called by Emergency Services to scenes.  Mr. Mancone will stress to the officers not to slacken their focus on parking tickets.  The meters are an important part of Village finances and must be enforced.
    2. Mayor Degnan motioned to approve the special use permit, Mr.  Schoenig seconded.  Mr. Ito asked if the County Planning was notified.  The Clerk stated notification was sent during the site plan approval process.  Vote taken – approved 5-0
    3. Mr. Banks motioned to set up a booth during Founders Day to inform the public of the several significant changes and accomplishments made by the Village over the last few years. Mayor Degnan seconded.  Passed 5-0
    4. Mr. Banks motions to give K.C. Anderson a Certificate of Appreciation for her excellent work and performance on Founders Day this year and prior years.  Ms. Anderson is a truly selfless promoter of the public good and should be recognized for the same.  Mr. Schoenig seconds.  Passed 5-0
    5. Mr. Schoenig said there was nothing in our laws that prohibits public urination, defecation, or noise and motions to hold a public hearing on September 29th to consider such laws.  Mayor seconds.  Passed 5-0 – Clerk to notice Public Hearing
    6. The Clerk requested clarification on accounts within the Village that had Village water and would be charged for public sewer.  The Mayor directed the clerk to contact the property owners and advise them of the situation requesting them to install water meters for this purpose.
    7. Ms. Piccini requested permission to submit applications for attendance for training of Planning Board members.  The money is appropriated and the training is required by New York State.  Mayor Degnan motions to approve the expense, Ms. Stockburger seconds, approved 5-0
    8. Mr. Mancone requests up to $300 for stickers, magnets, and pamphlets for the children on Founders Day to help the children and families understand that the Police are here to help them.  Mayor Degnan motions to allow Ms. Stockburger to spend up to $250 on these items from the Celebrations account.  Mr. Banks seconds.  Passed 5-0
  3. Public Comment
    1. Mr. Serino successfully secured alci-sensors and breath-a-lyzers from the County DWI program at no cost to the Village.  Mayor Degnan thanked Mr. Serino for the effort and success.
  4. Executive Session – Mayor Degnan motioned to go into Executive Session to discuss the Ground Lease particulars regarding the Parking Garage.  Mr. Banks seconded.  Passed 5-0
