The Board of Trustees of the Village of Brewster held a Regular Meeting on June 20, 2007 at Village Hall, 208 Main Street, Brewster, New York.  The meeting was called to order at 7:30 P.M. by Deputy Mayor and Trustee: William Banks

I - Deputy Mayor Banks reopens the Public hearing on Uniform Code.  Trustee Schoenig seconds.  All in favor - 4:0

Deputy Mayor Banks motions to adjourn the Public Hearing on Uniform Code until July 11th at 7:30 PM or as near thereafter as possible, Trustee Schoenig seconds.  All in favor - 4:0

II - Deputy Mayor Banks reopens the Public hearing on the Property Lease.  Trustee Schoenig seconds.  All in favor - 4:0

            Deputy Mayor Banks recognizes Brian Howells who provides a more detailed presentation and discussion of the parking garage.

III - Deputy Mayor Banks reopens the Public hearing on Sewer Rents.  Trustee Schoenig seconds.  All in favor - 4:0

            Rick Stockburger would like to see usage based rates.  He believes that this type of rate structure, including tiers will discourage water consumption and hence reduce the sewage outflow.  Christine Piccini says that a good user will win twice, once inflow of water and once outflow of sewage.  Antoinette Heit would like to see the rates based on service address and not units.  Christine asks about combining water and sewer bills on one bill.  Also could we consider budget billing?  Discounts for prompt payment?  And can we bill for sewer to defray incurred costs to date.

Public Comment:
Antoinette Heit questions the language in the easements for the collection system connections.  - who inspects the work?  Folchetti & Assoc.  What is the guarantee of performance?  5% held in escrow plus a performance bond.  Who handles complaints?  Guy Cilenti and Mike Corcoran who work for Folchetti.  Can you clarify the temporary easement v. the permanent easement?  Temporary of for connection and it expires in one year.  There is a permanent easement for maintenance.  What constitutes and emergency?  Trustee Ito explains that the Village will execute the contractual rights on behalf of the village property owners.

Trustee Ito asked the Village Attorney if he had prepared the letter in regard to clarifying the contractual rights of the Village?  Mr. Kropkowski stated that he had not.

2.  Resolution of Ground Lease - Deferred due to continued Public Hearing.

3.   Village Engineer report - Trustee Stockburger motions to accept the engineer's report, Trustee Schoenig seconds, all in favor - 4:0
            Mr. Folchetti departs ~9:10 PM

4. Insurance discussion.  - Mr. McKane of the DeForest Agency presents a proposal to the Board of Trustees regarding Village Insurance requirements.  Emphasis on Risk Management assistance, Shareholder v. Coop type companies, recommends bumping up the deductible on property loss portion as we have had no claims in the last 7 years.

Mr. Spain and Mr. Miles of the Spain Agency discuss the NYMIR insurance currently in force and up for renewal.  They claim that NYMIR is the only company that covers land use defense.  Mr. Spain informed the board that the Knox/Club Verona matter was not Spain's fault.  First the Spain Agency informed the board of trustees aka Village that the individual making the claim should be taken seriously, then the Spain Agency explained that the Village never informed them of the law suit in a timely fashion.  Therefore we were late in filing a claim.  And as such the Village had already incurred third party costs and filed a claim after the fact.  Mr. Kropkowski explained that this was not the case as the NYMIR attorney worked closely with the Village counsel to bring the matter to a quick and successful close.  NYMIR and Spain were both well aware of the Village Counsel involvement from the beginning.

5.  Police Report - The Chief of Police delivered the monthly report and asked about illicit discharge ordinance as well as a fine schedule.  Both are in the works.

Mayor Degnan motions to accept the Police report; Trustee Schoenig seconds, all in favor - 5:0

Mayor Degnan questions the branches in front of the police station and whether they need to be trimmed.  The Mayor also directed the clerk to respond to Supervisor Dunford's letter regarding posting of crimes for community review.

Planning Board - Christine Piccini: No new applications.  Need to resolve training requirements, board involvement in waivers, and routine process flow along with schedule of fees.

Public Hearing scheduled for July 25th on water/sewer/refuse billing.  Change user fees and frequency to "by resolution."  Mayor motions, Trustee Banks seconds, all in favor - 5:0

New Business -

Parking situation in village - Ito - 38 meters occupied at 11 AM mid week.  Should there be a 2 hour limit?  Can we re do signage?  Should we extend compliance hours? 

Stockburger - Smoke stations are in.  She will work with DPW supervisor to locate.
Mayor - Clock has been delivered.

Public Comment - Schoenig: Street lights are out and need repair.  Mayor asks Mr. Schoenig to follow up with NYSEG on the lights.

Jim Schoenig asks for a duplicate waiver of moratorium because he can't find the original and the building inspector needs it.  This was for a kitchen and passed last May (2006).  Application numbers: 528 and 529 dated May 3rd. 2006.  Mayor Degnan motions to waive moratorium and refer to building inspector, Trustee Banks seconds, All in favor - 4:0, Trustee Schoenig abstains.
