The Board of Trustees of the Village of Brewster is holding Public Hearings followed by a Regular Meeting on March 7, 2007 at Village Hall, 208 Main Street, Brewster, New York.  The meeting is called to order at 7:30 P.M. by Mayor Degnan.

PLEASE TAKE NOTICE that the Village Board of Trustees of the Village of Brewster will hold a public hearing at Village Hall, 208 Main Street, Brewster, NY, on March 7th, 2007 at 7:30 PM, or as soon thereafter as possible so interested parties may be heard, to consider a proposed Local Law, together with the significance thereof, which would amend Taxi license application procedures.  All persons having an interest in the proposed legislation will be given an opportunity to be heard at this time

There being no public comment or discussion the Mayor motioned to close the public hearing, Trustee Schoenig seconded.  Vote 4-0 in favor.

PLEASE TAKE NOTICE that the Village Board of Trustees of the Village of Brewster will hold a public hearing at Village Hall, 208 Main Street, Brewster, NY, on March 7th, 2007 at 7:30 PM, or as soon thereafter as possible so interested parties may be heard, to consider a proposed Local Law, together with the significance thereof, which would amend Snow Ban Parking rules.  All persons having an interest in the proposed legislation will be given an opportunity to be heard at this time

Discussion centered around a uniform period for effectiveness, perhaps Dec. 1 to March 15th.  This issue will come up for discussion again in the Fall.

Illicit Discharges, Activities and Connections to Separate Storm Sewer System

PLEASE TAKE NOTICE that the Village Board of Trustees of the Village of Brewster will hold a public hearing at Village Hall, 208 Main Street, Brewster, NY, on March 7th, 2007 at 7:30 PM, or as soon thereafter as possible so interested parties may be heard, to consider a proposed Local Law, together with the significance thereof, which would address MS4 Reporting of illicit discharge detection and elimination.  All persons having an interest in the proposed legislation will be given an opportunity to be heard at this time

Village Engineer John Folchetti explained that the Village was subject to fines per violation.  Mr. Folchetti suggests a local law be established to enforce regulations on construction and contractors within Village limits. 

A second law will be needed to control discharges and establish penalties for illicit discharges. 

There being no further public comment or discussion the Mayor motioned to close the public hearing, Trustee Schoenig seconded.  Vote 4-0 in favor.

  1. Public Comment
    1. Tom Sprague – Police parking space – Mr. Sprague suggested the special parking designation for the Police car in front of 31 Main Street to not be enforced for a short period of time.  The Mayor directed the Police Chief to issue warnings until April 1, 2007.  As of that date normal parking rules would be enforced for that space.
    2. Christine Piccini mentioned that parking rules were not being enforced on Prospect St.  Chief Mancone said his department and the highway department are working together to address proper notices.
    3. Review of 2 family homes with four bedrooms.  – Mayor Degnan stated the Village relied on State Code to determine occupancy.  There are ratios in place dependent  on the size of the bedrooms and laws that speak to lodgers vs. defined family members.  The Code Enforcement Officer is working to inspect and enforce all laws on the books as the Village looks into tying our regulations more thoroughly into the New York State Uniform Code.  This will give the Village the opportunity to address local issues using both local law and the State laws.   Terri Stockburger asked if there was a specific issue to report.   She then went on to say the Recent Rental Registration Law will help improve compliance.  Due diligence is paramount to ensure the laws are implemented methodically and carefully in order to do it correctly.

  2. Request for Waiver of Moratorium
    1. Dr. N.S. Aqeel 851 Rte. 22 – Mayor Degnan asked for Putnam County Board of Health opinion.  Dr. Aqueel said he would seek out their opinion and provide more information regarding water & sewer impact and return to the board in the future to request a waiver.
  3. Request for Special Permit
    1. Donut shop – represented by Mr. Nixon – A special permit had been granted for a Dunkin Donuts.  This request was before the board previously and Mr. Nixon was told to bring it to the Planning Board.  Mr. Nixon did this and was told to bring it before the Board of Trustees.

 

Mayor Degnan asked for the metes and bounds survey.  Also the demarcation of parking spaces are not shown on the drawing.  Mr. Nixon said there was a DEP permit for parking in place.
Mr. Nixon presented traffic flow recommendations.  Mayor Degnan asked for NYS DOT input.  Mr. Nixon says DOT input not needed if it is not in DOT right of way.  There are no signs proposed except on lot traffic flow directions.
Mayor Degnan asked about pedestrian traffic flow based on vehicular traffic flow because of exit traffic flow.  Mr. Nixon said there is separation of pedestrian walkways from traffic without any construction changes.  Trustee Ito said the Village has no currently enforceable traffic flow regulations that would apply to this property.  Mr. Nixon said the owner would be responsible as they have been in the past and contract with local towing firms. 
Village Engineer Folchetti asked if Dunkin Donuts was the tenant and if not then the special permit is not valid.  Mr. Nixon says they are the intended tenant but there is no guarantee that they will be the final occupant.  There is nothing signed as yet.  Mr. Folchetti asked if Mr. Nixon would submit a traffic and signage plan as parking on gravel is not orderly as there are no marked spaces.  Mr. Folchetti also wants more detail on pedestrian, exit, and traffic control as there is a still a question of safety,  Mr. Nixon states usage is staggered during the day.  Mr. Folchetti asked for traffic estimates from Dunkin Donuts.  Mayor Degnan asks for consensus on a special use permit vote.  Mr. Folchetti says he needs more information to make a proper SEQRA determination before a special use permit vote.  Mayor Degnan asked if a 4-way stop intersection been investigated.  Mr. Nixon said not really.  Mayor Degnan stated that the safety of the intersection is paramount – DOT and DEP should be consulted and offers his assistance in that regard.  Mayor Degnan said it seems there is a consensus not to vote on the special use permit until more information is gained.  Mr. Nixon will continue his efforts on client’s behalf.

Mayor Degnan asks Mr. Folchetti to provide a recommended schedule of Retainage reduction over the next twelve months which will be considered at the next meeting.

Mayor Degnan makes a motion to approve request, Terri Stockburger seconds, Passed 4-0

    1. Honorable Richard O’Rourke to address Board of Trustees – Judge O’Rourke is very concerned about the safety and security of the clerks during the day and the courtroom when in session.  Certain deficiencies were identified and Mayor Degnan agreed to address the Safety of the Clerks and increased security while working with the court to come up with a comprehensive plan,
    1. Parking regulations are undergoing a complete review and recommendations will be forthcoming.
    1. Mr. Mitts asked if the 2006 AUD was complete yet.  Clerk said not yet.  He also asked for the Budget schedule for the upcoming year.  Trustee Ito said draft by March 31, Public Hearing by April 15th and adoption by May 1 are the goals.
    2. The Cameo’s marquee façade will be improved no later than Spring of 07.
    3. Mr. Sprague said there were currently eleven food vendors on Main Street and asked if the Village might consider limiting that number to lessen impact on sanitary sewer system. Village Attorney Kropkowski said that it might be considered in the revised zoning regulations. 
    4. Mr. Stockburger asked about the status of the zoning regulations and the Mayor said that counsel was making good progress but is also handling the Town of Southeast litigation and it is a matter of priorities.
