The Board of Trustees of the Village of Brewster held a Regular Meeting on Thursday, 18 January 2007 at Village Hall, 208 Main Street, Brewster, New York.  The meeting was called to order at 7:30 P.M. by Mayor John Degnan.

Deputy Mayor Banks convened the meeting.
Mayor Degnan was absent due to immigration discussion at Brewster Library.
Village Attorney Kropkowski arrived mid-meeting due to Army Reserve commitment.

  1. Public Comment
    1. Sean Mitts asked about the status of the FY2006 Financial report.  The Clerk related that preparation was proceeding, no additional correspondence has been received by the Village since CPA John Bryan contacted the sender of the last letter at the OSC. 
  2. Request for Waiver of Moratorium
    1. 90 Oak St. - Greg Folchetti representing Sniffen at 90 Oak St.  Bldg. permit approved in 2001, renewed in 2003.  Space suffered water damage and the building inspector granted a renewal to repair that expired 90 days after 10/18/06.  Subsequently a Certificate of Occupancy was denied by Mr. Zarzeski.  Mr. Zarzeski noted that the same layout appears on all applications as originally permitted.  Trustee Stockburger motioned to waive the moratorium, Jim Schoenig seconded.  Passed 4-0
    2. 52 Oak, vestibule addition and rehab kitchen – Annette Lindberg representing Christopher and Sandra Riccio -  Motion to grant waiver by Deputy Mayor Banks, seconded by Trustee Ito, Passed 5-0
    3. 20 Prospect St - Fence - Trustee Stockburger motioned for waiver, seconded by Mr. Banks, passed 4-0
    4. 114 Main Street - Mr. Nixon - 2 lot subdivision
    5. Trustee Stockburger motioned to waive moratorium, Trustee Schoenig seconded , passed 4-0
    6. 538 N. Main - Louis Pizza bldg.  Since the last meeting Mr. Budzinski from Putnam County Board of Health has agreed that no additional load would be put on the existing septic than previously existed as long as the second floor was for storage only.  Based on the conditions delineated in these minutes and on the waiver of moratorium proper the waiver is proposed for approval by Deputy Mayor Banks, seconded by Trustee Schoenig, approved 4-0
  3. Engineer’s report - John Folchetti delivered the engineer's report. - Jim Schoenig motioned to accept, seconded by Mr. Banks, and passed 4-0.
  1. WWTP Subdivision - Deputy Mayor Banks motioned to use the existing SEQRA submittal for the WWTP plant and declare Village of Brewster lead agency and declare a negative declaration, Trustee Stockburger seconded, approved 4-0..

 

    1. John Folchetti advised that budget line item for Stormwater was nearly depleted and suggested moving $5,000 from contingency to cover Software.  Board approved.  4-0
    1. John Folchetti indicated that the maintenance budget for Marvin Ave. Line needs to incur the costs of enzyme additions (as planned) at the Marvin Avenue Sewer Pump Station to begin the process of decomposition prior to reaching the WWTP intake.  Trustee Ito motioned to approve, seconded by Trustee Stockburger, approved 4-0
  1. Brewster Police Department - 3)       Brewster Police Department update and action
    1. Resolution - State Police dispatch procedure & protocol with members of State Police and County Sherriff (see attached)
    2. Resolution – Authorization to use Town of Harrison Pistol Range and Indemnification. (see attached)
  2. Approval of Vouchers

On a motion by Trustee Stockburger seconded by Trustee Schoenig the following the duly constituted Board of Trustees of the Village of Brewster hereby authorizes the Village Clerk/Treasurer to pay December, 2006 vouchers totaling as follows:

    1. A Fund: $120,803.73
    2. F Fund: $14,205.97
    3. G Fund: $42,728.88
    4. H10 WW Capital Fund: $532,895.04
    5. H20 Marvin Ave. Sewer Capital Fund: $1,499.00
    6. H9 PW Capital Fund: $50,220.19
    7. T00: $203.20

Total:    $762,556.01

  1. Payroll outsourcing – The Clerk requested the board’s approval to outsource payroll to Paychex.  The Village is not bound by any contract and the action can be rescinded or reassigned at any time in the future.  The board agreed.  Trustee Stockburger motioned, Deputy Mayor Banks seconded.  Passed 4-0.
  2. New Business - Parking Pay Stations - Trustee Ito will work on number of spaces and evaluate density to determine high return areas. 
  3. Public Comment –
    1. Christine Piccini asked about the status of the new Zoning code.  Dan Hollis firm is working on them.
    2. Christine asked about broadcasting meetings and questioned whether we could include that in cable franchise contract renewal.

Resolution
The duly constituted and authorized Board of Trustees of the Village of Brewster, New York this 18th day of January, 2007 does hereby state and resolve upon motion of Terri Stockburger, seconded by Jim Schoenig the following:

WHEREAS, the Village of Brewster Police Department (VBPD) consists of eight (8) part-time police officers and one (1) part-time supervisory officer, Chief Alex Mancone, and is now required to satisfy the administrative, personnel and logistics requirements set forth by state and local laws, and the police communications standards and parameters set by the New York State Department of Criminal Justice Services (DCJS); and

WHEREAS, local law enforcement agencies are required by both state law and county charter to effect working police procedures and communications protocols between the VBPD and the New York State Police and the Sheriff's Department of Putnam County, New York; and

WHEREAS, New York State Village Law Section 4-412 authorizes and requires the municipal Board of Trustees to take every action within its statutory powers to preserve and safeguard the health, welfare and safety of the residents and inhabitants of the Village of Brewster, New York; now, therefore be it

RESOLVED, that the Board of Trustees of the Village of Brewster does hereby authorize the VBPD by Chief Alex Mancone to immediately establish the communications and procedural protocol with the New York State Police (NYSP) and the Putnam County Sheriff's Office (PCS)) for the monitoring and responding to all Emergency/911 (E-911) calls, municipal emergency police and fire department calls and other police dispatches as shall be required by federal, state and local laws; and be it

FURTHER RESOLVED, that the Board of Trustees further authorizes and requires Chief Alex Mancone to immediately effect the administrative and departmental liaison between the VBPD and the NYSP Brewster Barracks to facilitate and expedite the Village's part-time Police Department in conducting and establishing effective training, personnel and administrative standard operating policies and procedures (SOPs) for the municipal law enforcement agency; and be it

FURTHER RESOLVED, that this resolution shall be forwarded immediately to the Commander, Troop K headquarters of the New York State Police; the Sheriff of Putnam County, New York; the Office of Public Safety of the NYS Department of Criminal Justice Services and the Village of Brewster Police Department.

Resolution
The duly constituted and authorized Board of Trustees of the Village of Brewster, New York this 18th day of January, 2007 does hereby state and resolve upon motion of Bill Banks seconded by Terri Stockburger the following:

WHEREAS, the Brewster Police Department desires to use the Town of Harrison Police Department Pistol Range.

WHEREAS, the Town of Harrison and Village of Harrison require from any municipality requesting use of its Pistol Range proper insurance naming the Town of Harrison and Village of Harrison as additional insureds and a fully executed Indemnification Agreement inuring to the benefit of the Town of Harrison and Village of Harrison;

NOW THEREFORE, BE IT RESOLVED that an Indemnification Agreement inuring to the benefit of the Town of Harrison and Village of Harrison be executed, and be it further

RESOLVED that the Village Board of Trustees of the Village of Brewster authorize the Spain Agency on behalf of NYMIR to execute the attached Indemnification Agreement, and to deliver same to the Town Attorney of the Town of Harrison, and be it further

RESOLVED that a copy of this Resolution be forwarded to the Town Attorney of the Town of Harrison with a fully executed copy of the Indemnification Agreement.
